Can I get workers’ compensation if I only work part-time?

part time workerYes. Definitely. Absolutely. I once had someone tell me that they believed they could not get workers’ compensation for an on-the-job injury because they only worked part-time and did not “have benefits.” This thought could not be further from the truth.

If you work part-time you are just as eligible for workers’ compensation coverage as your full-time counterpart. There is no minimum number of hours a week you must work to qualify. There is no minimum amount of time on the job you must have to qualify. You are covered from day one.

If you work part-time and are injured on the job, you are still entitled to medical care, weekly pay if you are written out of work, and payment for any permanent disability you suffered as a result of your injury.

If, as a part-time employee, you are hurt at the actual job site, while driving a motor vehicle, whether your own car or a company car, van or truck during the course of your workday, at a company function or involved in an accident while working at another business, you are covered under the South Carolina Workers’ Compensation Act.

Don’t let anyone tell you that you are not entitled to workers’ compensation for your injury because you do not have “benefits.” Just because your company does not pay for your health insurance or other benefits has no relation to if you are covered under workers’ compensation insurance. Your employer is required to carry workers’ compensation insurance if they employ four or more full-time or part-time employees on a regular basis. There are a few exception to this general rule, but the exceptions are rare. If they do not carry workers’ compensation coverage then they may be in violation of the law and you may still receive benefits from the South Carolina Uninsured Employers’ Fund.
